Formal charges were filed Thursday in the September 4th Winder, Georgia, school shooting against the father and the son who had warned his parents he should be in a mental institution.

The Barrow County grand jury indicted 14-year-old Colt Gray on a total of 55 counts, including murder in the deaths of two teachers and the two students they were trying to protect and 25 counts of aggravated assault -- seven other students and a teacher were wounded.

His father will stand trial on 29 counts, including two counts of second-degree murder. That's an unusual charge under Georgia law, resulting from a death of a child when someone is committing the crime of cruelty to children.

54 year old Colin Gray, is accused of that by giving his son access to a gun and ammunition even after, prosecutors say, the boy asked his mother to put in in "a mental asylum."

The Grays are scheduled for another court appearance next month to enter a plea. Their lawyers have not asked for bail for either of them.
