    In response to the crisis, Florida Governor Ron DeSantis signed HB-1021 into law on May 24, 2024. Effective July 1, 2024, the bill overhauls state laws governing condo oversight and management.

    HB-1021 introduces new professional practice standards for Florida community association managers (CAMs) and CAM firms and updates multiple requirements for maintaining HOA official records.

    HB-1021, known as the "HOA Reform Bill," introduces several key changes:

    • Mandatory financial audits for associations with annual revenues exceeding $500,000.
    • Stricter rules for board member elections, including term limits and enhanced vetting processes.
    • Increased penalties for fraudulent activities, with potential felony charges for significant financial mismanagement.

    HB-1203: A New Era for HOAs
    On May 24, 2024, Governor DeSantis signed HB-1203, revamping Section 720 of the Florida Statutes (the “HOA Act”) and promoting transparency amongst parcel owners, CAMs, and board members.

    HB-1203 implements new professional standards for Florida CAMs and updates multiple requirements for maintaining HOA official records. By January 1, 2025, every HOA with 100 or more parcels must post a current digital copy of certain official records on its website or make those documents available through a mobile-device-compatible application.

    HB-1203 complements these reforms by focusing on dispute resolution and homeowner rights:

    • Establishment of an ombudsman's office to mediate conflicts between homeowners and associations.
    • Enhanced protections for whistleblowers who report suspected fraud or mismanagement.
    • Improved access to association records for homeowners, including financial statements and meeting minutes.

    These legislative changes have significantly altered the landscape of HOAs in Florida. They provide a robust framework for preventing fraud, promoting transparency, and ensuring accountability among HOA boards and management.
