    Driver charged with homicide by vehicle in fatal 2022 York County crash

    YORK COUNTY, Pa. (WHTM) — A driver from a fatal 2022 crash in York County is facing homicide by vehicle and other charges.

    According to the charges filed by Newberry Township Police, Jose Rivera Jr., 34, of Harrisburg, was speeding when he caused the deadly crash on the 700 block of Old Trail Road on Oct. 4 .

    Yahaira Montero, 39, was killed in the crash. According to police, she was sitting in the front seat on the passenger side of a red Toyota sedan that Rivera was driving.

    Montero died from “multiple blunt force injuries,” according to the York County Coroner’s Office.

    Police say an investigation revealed that Rivera was traveling south when he crashed into a Jeep going the other way. At the time of the crash, police say Rivera was going about 60mph in a 35mph zone.

    A witness also reported that Rivera had passed them, while in a no-passing zone, and it was wet outside during the time of the crash, police noted in the charges. Rivera’s blood results also showed that he was under the influence of marijuana.

    Two people, along with Rivera were injured in the crash.

    Other than homicide by vehicle, Rivera faces DUI charges.
