    York County teen charged after juvenile shot by stolen firearm

    CUMBRELAND COUNTY, Pa. (WHTM) — An 18-year-old in York County is facing charges after a friend was shot while handling a stolen firearm.

    According to an affidavit from Pennsylvania State Police, on October 6 at approximately 3:55 a.m., officers were notified that friends were transporting a 17-year-old juvenile to Penn State Holy Spirit Hospital Medical Center with a gunshot wound to the head.

    The affidavit says upon arrival at the hospital police learned that the victim and their friends were out partying and underage drinking the night leading up to the incident. A witness reported that the shooting occurred after the victim and his friend, 18-year-old Adler David Guererro were picked up by his girlfriend.

    The affidavit says Guerrero was the front-seat passenger, his girlfriend was the driver, and the gunshot victim sat in the middle of the second row.

    According to the affidavit, in the area of Carroll Township, the victim reportedly retrieved a pistol from Guerrero’s backpack and fired a shot. When Guerrero and his girlfriend turned around, they observed the victim sustained a gunshot wound to the head.

    The affidavit says Guerrero and his girlfriend chose not to call 911 and instead called their friends. They decided to drive the victim to the hospital themselves and made several stops along the way. Police say Guerrero encouraged his girlfriend to stop in the West Shore Country Club area so Guerrero could throw the firearm out the window. After retrieving the weapon, police discovered that Guererro’s weapon was stolen from York County and confirmed Guerrero had possession of the firearm for at least one month, per the affidavit.

    The affidavit also says that friends reported that Guerrero had been highly intoxicated the night before and may have pointed the firearm in the direction of unknown people in the Shippensburg area. Guerrero’s friends reported that they removed the firearm from Guerrero while they were in the area, but Guerrero retrieved it before leaving with his girlfriend and the victim.

    Guerrero was charged with receiving stolen property, possession of a firearm without a license, tampering/fabricating physical evidence, and corruption of minors and was taken to Cumberland County Prison. He posted $15,000 bail and is currently awaiting his preliminary hearing on October 23.
