RIVERTON, Utah (ABC4) — A second man was indicted by a grand jury in the shooting death of a Riverton man that took place in August.

Max Day, 20, was indicted Thursday on one count of obstruction of justice related to the shooting that killed a 19-year-old man.

Police responded to a shots fired call in the Monarch Meadows neighborhood of Riverton just before midnight on Aug. 18.

Officers found that the man had multiple gunshot wounds. He was taken to an area hospital where he was pronounced dead.

According to charging documents, detectives found a wallet at the scene. The wallet contained a Utah driver’s license, a student ID from Utah Valley University, and three bank cards.

Officers went to an address in Orem identified from the wallet they found at the scene. They reportedly found a silver passenger car matching what was seen on surveillance video the night of the shooting. In an interview with authorities, Day allegedly admitted to driving the vehicle during the shooting, which happened near Skipperling Lane.

“Day told detectives that Thomas Leelyn Rose, 19, had been with him. Day, Rose, and the deceased had an interaction,” charging documents say.

After Rose reportedly fired multiple shots at the victim, Day and Rose sped from the scene. Day also told detectives that Rose threw Day’s phone out of the car so police couldn’t track them.

Day allegedly admitted to police he also removed the license plate and any identifying stickers from the car.

Charges are allegations only. All arrested persons are presumed innocent unless and until proven guilty beyond a reasonable doubt.
