Hello, as many of you are away many fast food places have started charging $0.10c for take out bags under the extended city’s ordinance 187716 which is extended from Senate Bill 270. My concern is the $0.10c bag fee for single use paper bags is getting taxed by these business but the single use paper bags are actually tax exempt according to the California State Board of Equalization (see this notice: ( https://static1.squarespace.com/static/54d3a62be4b068e9347ca880/t/583f377c3e00bebc1c96a04d/1480537980594/Charge+Not+a+Tax.pdf ) . Also in Senate Bill 270, Article 1, Section F, Subsections B and C it states it specifies that a “single-use carryout bag” does not include nonhandled bags used to protect purchased items from damage or contamination or bags provided to contain unwrapped food items. My main concern is the $0.10c tax exempt fee is getting taxed.
