    Spencerport man arrested on assault charge after injury of sergeant in Bath

    SPENCERPORT, N.Y. ( WETM ) – A Spencerport man has been arrested after an incident that led to the injury of a sergeant in Bath at the end of June.

    According to the Village of Bath Police Department, David C. Cervantes, 38, was arrested on Saturday, June 29, on the charge of assault in the second degree, a class D felony.

    Cervantes’s charge stems from an incident that occurred on that same day on Howell Street, where police say a sergeant and an officer were called to assist Bath Ambulance with a medical call around 11:37 a.m.

    Upon arrival, police say that Cervantes became non-compliant and attempted to strike the sergeant by swinging his elbow at them. Police then say that after a brief altercation, Cervantes kicked the sergeant in the head, causing injury.

    Cervantes was then arrested and taken by ambulance to Ira Davenport Hospital, where police say he was found to be under the influence of meth. He was later released and then transported to Bath Police Department for arrest processing before he was transported to the Steuben County Jail to be arraigned at CAP court. Cervantes was then released from CAP court and is set to appear again in court in the future.

    The injured sergeant was evaluated by medical professionals and suffered trauma to the head as a result of the incident.
