    Man charged with shooting other car's window out in Millbury

    MILLBURY - A man is facing charges after he allegedly shot out another car's window in a case of road rage in Massachusetts, leaving the other driver frightened.

    It was a terrifying morning commute for a Worcester man who was shot at along Route 146 near Millbury. The victim doesn't want to be identified, but his passenger side window was shattered by what he initially thought was a handgun.

    "I told the police officer that I saw the gun and I saw him. He's, like, dark-skinned person," he told WBZ-TV.

    The 27-year-old Worcester resident said he was on his way to work when he was stuck behind a red Honda Civic that was driving slowly. The chaos ensued when he tried to pass the car.

    "And he come from the back and he shoot and he tried to run away," the victim said. "Like, shooting at the window and then he run."

    His photos led police to 39-year-old Daniel Ochoa, who was arrested on a job as a roofer. He pleaded not guilty in Worcester District Court.

    "They were able to recover what was a pellet gun immediately in a barrel next to the Honda Civic that was parked and operated by the defendant," the prosecutor told the judge.

    The handgun turned out to be a BB gun.

    "There does seem to have been some damage to the other vehicle, if my client is the shooter, but it's not a handgun, nobody got hurt, thankfully," Ochoa's lawyer said in court.

    "Don't do this"

    No one was hurt, but the victim is shaken up by the violence.

    "For no reason, he's shooting," he said. "In the morning, I was shaking like crazy."

    His passenger seat is covered in broken glass. He has this message for Ochoa.

    "Relax. Don't do this, it's not worth it to do all this stuff."

    Bail was set at $1,000 cash and the judge ordered Ochoa to stay away from the victim and to not have any weapons. The victim said he doesn't want to press charges but he called 911 to make sure this doesn't happen to anyone else.
