    RFK Jr.'s effort to be removed from Wisconsin ballot meets road bump in Dane County

    MADISON, Wis. -- Robert F. Kennedy, Jr. encountered a bump in the road Friday in his push to be removed from the presidential ballot in Wisconsin.

    Dane County Judge Stephen Ehlke denied Kennedy's motion for an emergency ex parte temporary restraining order. Kennedy had asked the court to put a hold on the Wisconsin Elections Commission's order to keep him on the ballot for November's presidential election.

    "A matter of such consequence deserves a full development of the record with appropriate briefing by all sides," Ehlke wrote in his decision and order.

    Kennedy is seeking to wipe his name off of the presidential ballot after suspending his campaign and endorsing former President Donald Trump last month. In a lawsuit filed in Dane County earlier this week, he argued that Wisconsin law discriminates against third party candidates by treating them differently from Republican and Democratic presidential candidates.

    The WEC last month voted to keep Kennedy on the ballot despite an attempt to remove him, citing a state law that says independent candidates who submitted nomination papers before the Aug. 6 deadline cannot be removed from the ballot after the deadline unless they die.

    Ehlke set a scheduling conference in the case for Sept. 11, one week before the deadline for local clerks to mail out absentee ballots to voters who have a request for on on file.

    WI LAW 8.35 (1): Any person who files nomination papers and qualifies to appear on the ballot may not decline nomination. The name of that person shall appear upon the ballot except in case of death of the person. A person who is appointed to fill a vacancy in nomination or who is nominated by write-in votes is deemed to decline nomination if he or she fails to file a declaration of candidacy within the time prescribed under sub. (2) (c) or s. 8.16 (2).
