CHAPMANVILLE, WV (WOWK) — A doctor in West Virginia has been indicted and will appear in court on Thursday for distributing Clonazepam, also known as Klonopin, for no legitimate medical purpose, according to court documents.

Documents show that Brian McDevitt is a doctor of osteopathic medicine (D.O.) in the Chapmanville area of Logan County. McDevitt was indicted on three counts for distributing the drug, a Schedule IV controlled substance, between May and July 2023.

If convicted, McDevitt could have to give up property involved in the alleged crimes, which could include his West Virginia medical license as well as the Chapmanville Medical Center at 384 Main Street, according to court documents.

McDevitt appeared in court on June 12, one day after his indictment was filed. He has been released on a $10,000 unsecured appearance bond with an order setting conditions of his release. He is due back in court on Thursday at 11 a.m. in Charleston, court documents show.

Clonazepam is a benzodiazepine used to treat panic disorder and seizures, according to the National Alliance on Mental Illness. Other well-known benzodiazepines are Valium and Xanax, which are also Schedule IV controlled substances because there is a potential for abuse, according to the U.S. Department of Justice.

In documents filed on Jan. 20, 2010, Dr. McDevitt pleaded guilty to conspiracy to use a registration number and engaging in monetary transactions in property derived from specified unlawful activity.
