A driver accused of being impaired hit a married couple riding a golf cart, killing the husband, North Carolina officials said.

Roy Shane Epps, 58, and his 57-year-old wife were on the golf cart when a Chevrolet Malibu crashed into them Saturday, Oct. 12, the N.C. State Highway Patrol wrote in a news release and told McClatchy News in an email.

Epps, a Granite Falls resident, was flown to a hospital and died from crash-related injuries. His wife suffered life-threatening injuries, according to state troopers.

Investigators responded to the crash at about 3:10 p.m. in Caldwell County, a roughly 75-mile drive northwest from Charlotte. It happened as Epps was operating the golf cart and tried to turn out of a driveway, “into the path of” the Malibu, highway patrol said.

Troopers, who believe impairment played a role in the crash, arrested the Malibu driver and charged him with DWI. Their news release didn’t list attorney information for the man, identified as 33-year-old Cody Lyndon Pennell of Morganton.

“Additional charges are pending upon completion of the ongoing investigation and consultation with the Caldwell County District Attorney’s Office,” troopers wrote.
