Investigators determined Eugene Ndikum was driving the SUV when he ran a red light, causing the crash. A search warrant was obtained for Ndikum's blood, and testing by the DPS lab revealed his blood alcohol concentration was nearly twice the legal limit of .08.

The crash occurred back on December 12, 2023. On June 6, 2024, Eugene Ndikum was indicted by a Grand Jury and arrested by Sugar Land Police for Felony Intoxication Assault.
