    The Greenbrier will not be auctioned; debt is paid: Justice family says

    WHITE SULPHUR SPRINGS, W.Va. (WBOY) — The second planned auction for The Greenbrier Resort will reportedly not happen, as the Justice family announced Tuesday night it has repaid its debt to Beltway Capital, the owners of a loan for the resort.

    According to a statement from the Justice family, they have “completely satisfied” their obligations to Beltway Capital and have paid their debt “in full.” The family emphasized its stance that it had made all of its required payments ahead of their due dates under the settlement agreement.

    The announcement also said that with the full repayment to Beltway, the planned auction for the resort set to be held Oct. 25 has been “cancelled and fully withdrawn.”

    The fate of The Greenbrier has been in flux over the past few months after a legal notice of trustee’s sale was posted for the resort in August, which planned to put the resort up for auction. This was due to JPMorgan Chase—the original owners of the loan Justice used to purchase The Greenbrier—selling that loan to Beltway Capital, which immediately declared it in default and began a lawsuit against Gov. Justice, per a statement from him and his family.

    Justice and his family, who have owned the resort for 15 years , claimed the moves were political in nature , calling it “ANOTHER POLITICAL STUNT BY THE DEMOCRAT MACHINE” and vowed to defend their claims to the resort and to take “necessary protective action.”

    About three weeks later, the two parties came to an agreement that would prevent the sale of The Greenbrier’s assets, so long as Beltway Capital received “a specific amount” of money by Oct. 24, 2024.

    However, on Oct. 10, another legal notice of trustee’s sale was posted for the resort that said a default had occurred under the terms agreed upon and that the resort would be auctioned on Oct. 25 at 2 p.m. at the front door of the Greenbrier County Courthouse. A representative of the resort told 12 News’ sister station WVNS that the notice was merely a “procedural matter” and that Beltway would be paid in full by the Oct. 24 due date.
