    Plaintiff sustained injuries in high-speed, rear-end collision

    This first-party claim for no-fault personal injury protection benefits arises out of an automobile accident that occurred on March 17, 2021. The plaintiff was rear-ended at a high rate of speed.

    The plaintiff did not seek medical care until the next day, when she went to primary care physician. She was sent to physical therapy. Her injuries got worse over time, and she sought help from other specialists.

    The plaintiff sustained injuries to her back, neck and right shoulder. She received extensive medical treatment, which ultimately culminated in a lumbar fusion surgery.

    The defendant didn’t pay for the treatment and relied on paid DME doctors who saw the plaintiff one time and then opined that she was not entitled to benefits.

    A judgment of $750,000 was achieved, almost the entire amount of benefits claimed. A motion for attorney fees, costs and penalty interest is pending.
