John Shockley, counsel for the Diversion Authority, says the developer is making aggressive claims that won’t hold up after review. Shockley and the city pointed to regulations in the contract that specify epoxy-coated rebar be used for structural integrity purposes. It’s likely the dispute will now head to informal arbitration board, and there’s a possibility of civil litigation.
