    Docs: Fight over gang affiliations led to fatal apartment shooting in far East El Paso

    EL PASO, Texas ( KTSM ) — A 24-year-old man is dead after an argument about opposing gang affiliations escalated to a shooting at an apartment complex in far East El Paso this past weekend, according to court documents obtained by KTSM.

    According to court documents, Damian Alexander De La Riva, 19, is facing a charge of murder after Omar Infante Jr., 24, was shot and killed just before 4 a.m. on Saturday, July 20, at the Gonzalez Place Apartments in far East El Paso.

    De La Riva was arrested and booked into El Paso County Jail on Monday, July 22 under a $1 million bond. Police have yet to release his mug shot.

    Court documents say there was a small get-together that Saturday morning at an apartment where two witnesses, Infante, De La Riva, and another male suspect were present.

    Court documents say an argument ensued between Infante and the male suspect regarding their opposing gang affiliations.

    De La Riva, the male suspect, and Infante were kicked out of the apartment by one of the witnesses.

    Infante and the male suspect agreed to fight each other and walked down the stairwell of the apartment building toward the parking lot area.

    De La Riva stayed at an upper level of the stairwell. Infante and the male suspect then began fist-fighting when De La Riva ran down the stairwell, pulled out a black handgun, and pointed it at Infante, according to court documents.

    Infante then released his hold on the male suspect and backed away from both men with his hands in the air.

    Court documents say video footage shows a shot striking Infante with both men beating Infante in the face afterward while lying on the floor motionless. Court documents say Infante was “beaten, stomped, and pistol-whipped numerous times.”

    Court documents say De La Riva and the male suspect grabbed an unknown item from Infante’s torso and walked away. They then fled the apartment complex in a vehicle.

    Police are still seeking the second suspect in this case.
