The driver accused of hitting and killing a 77-year-old man near Miami Valley Hospital North this week appeared in court on Wednesday, but it wasn’t for charges connected to the deadly crash.

Daryl Dillard, 60, appeared before a judge in Miamisburg Municipal Court on Wednesday for the first time since Monday’s crash.

The Montgomery County Sheriff’s Office confirmed to News Center 7 that Dillard was the driver involved in the deadly wreck on N. Main Street in Englewood. Jail records show he was arrested at the hospital Monday night, but he is not yet facing charges in connection to the crash.

Dillard appeared in court Wednesday for a probation violation, which is what he’s being held on in the Montgomery County Jail.

“Ok, you are here on a probation violation,” Judge Alyse Rettich said.

As reported on News Center 7 at 5:30 , court records show the probation violation is tied to an OVI conviction from last year. Documents show that after already failing to report and complete a court-ordered drug and alcohol screen, the violation notice was updated this week to say Dillard broke his probation again because of his suspected involvement in a “crash that resulted in the death of one person and critical injury of another.”

The Montgomery County Coroner’s Office said 77-year-old William Rodenberg, of Tipp City, died in the crash. A 74-year-old man was also critically hurt.

On Wednesday, the judge ordered that Dillard be held without bond for the probation violation.

As for the crash investigation, investigators from the sheriff’s office told News Center 7 that they suspect impairment may have played a factor, but are waiting on test results to confirm that. Charges connected to the crash are pending.
