    Man charged in fatal Fayetteville hit-and-run allegedly failed sobriety tests

    The man accused of being impaired when he struck and killed a pedestrian Tuesday night on Murchison Road reportedly attempted to kick open the door of the patrol car after he was detained and spit in the interview room once in custody, according to court records.

    Logen Dustin Harvey, 22, of Parkton, is charged with felony death by vehicle, felony hit-and-run causing serious injury and misdemeanor driving while impaired in the hit-and-run death of Tyrone Thomas Jr., 25, of Fayetteville, according to the Fayetteville Police Department.

    Harvey allegedly struck Thomas after speeding past a Cumberland County Sheriff's deputy at about 10 p.m. in an area of Murchison and Shaw Mill roads, an affidavit states. Court records state that the deputy also noticed Harvey's vehicle did not have its headlights or taillights on.

    According to the record, Harvey was allegedly traveling so fast that the deputy could not catch up. The deputy was flagged down at the intersection of Murchison Road and Pamalee Drive and told by a witness that a person was hit, and the vehicle fled the scene, court records state.

    Thomas was pronounced dead at the scene, according to court records.

    According to a GoFundMe page to raise money for funeral expenses, Thomas was crossing the street after leaving work at a nearby McDonald's and was struck as he turned to wave goodbye to coworkers. The GoFundMe said he was on the phone with his mother and in a crosswalk when he was hit. Thomas's death came four days after his 25th birthday.

    The Sheriff's Office alleges that shortly after Thomas was struck, Harvey drove away from a deputy who found his vehicle in the 2300 block of Murchison Road. A three-minute pursuit began onto Langdon Road until the suspect struck another vehicle at Ramsey Street and stopped less than a mile away near the Veteran's Affairs Office in the 2300 block of Ramsey Street, the Sheriff's Office said.

    Harvey was detained at 10:18 p.m. and turned over to the custody of the Fayetteville Police Department because the incident happened in the city's jurisdiction, the Sheriff's Office said.

    An affidavit states Harvey was noted to "have an odor of alcohol, red glassy eyes and slurred speech," when he was detained.

    A deputy administered a sobriety eye and breath test, which Harvey allegedly failed, according to the affidavit. The record did not note what the results of blood and breath tests for alcohol impairment were. While detained in the back of a patrol car, Harvey allegedy attempted to kick open the patrol car door and during an interview with police, he spit, the records note.

    Harvey's bail is set at $500,000, according to court records.
