Voters in the Sunshine State will decide the fate of a ballot measure claiming to protect abortion through viability, but the language of the proposed amendment is reportedly confusing voters.

Florida is one of several states that will vote on a measure regarding abortion in November, but an Engagious/Sago focus group reported by Axios shows that voters are hesitant to support the measure over its vague phrasing.

Amendment 4 would prevent the state from creating legislation that would “prohibit, penalize, delay, or restrict abortion before viability or when necessary to protect the patient’s health, as determined by the patient’s healthcare provider.”

Opponents of the measure have claimed the language of the amendment is intentionally vague and would open the door for little to no restrictions on abortion. The main opponents of the measure argue the lack of clear definitions for “viability,” “patient’s health,” and “healthcare provider” make the measure dangerous.

In the focus group, one of the participants said the measure was "kind of a loaded sentence," while another said they thought "'before viability' is not clear enough," according to Axios. The report suggests that six of the 13 participants needed the language of the measure to be clearer to support it, while five of them said they would support it.

The measure would require a 60% vote on Nov. 5 to pass, and a June Fox News poll showed 69% of Florida voters supporting the proposed amendment. The poll was conducted prior to the main opposition group to Amendment 4 launching its campaign in July.

Democrats have seen Florida as potentially in play in November with the abortion measure on the ballot, but a recent dip in polling for President Joe Biden after his disastrous debate in June has seen those hopes fade.
