    What is Prop 3? A look into the ‘Right to Marry and Repeal Proposition 8 Amendment’

    ( KRON ) – Proposition 3, otherwise known as the ”Right to Marry and Repeal Proposition 8 Amendment,” is attempting to legalize same-sex marriage in California – permanently – by repealing a previous amendment that banned gay marriage across California.

    In 2008, voters passed Prop 8 — a measure supporting a ban on LGBTQ+ marriage in the California constitution by defining marriage as “between one man and one woman.” That letter is now dead, as the U.S. Supreme Court legalized same-sex marriage nationwide in 2015.

    Despite not being enforceable today, some fear that if the Supreme Court were to overturn that 2015 ruling, then the language of the now-dead letter banning same-sex marriage in 2008 could then come back to life, re-criminalizing same-sex marriage in California.

    “This ballot measure comes at a pivotal moment when the U.S. Supreme Court has made clear its willingness to revoke hard-won rights, endangering the freedoms of millions of Californians,” the American Civil Liberties Union of Northern California said.

    San Francisco first started issuing licenses that legalized same-sex marriage in 2004. The state high court then legalized unions advocating for same-sex marriage in 2008. Several months later, however, voters passed Prop 8 –- the measure Prop 3 is now attempting to curb.

    Supporters believe the measure will give LGTBQ+ groups basic rights and also help certain groups in religious communities. “As a faith leader, I support Proposition 3 because it protects the right to marry while respecting faith communities’ First Amendment rights,” Rev. Jef R. Johnson, bishop of the Evangelical Lutheran Church in America’s Sierra Pacific Synod, said.
