    TikTok influencer discovers someone else copyrighted her viral phrase

    This lawyer says it all right here, but only says that she has a "strong argument" to win the rights. He said, "if you believe that you have something that's commercially viable, that's catching on, and that people are going to associate with you, then you need to go ahead and protect that." Posting it on TikTok with a timestamp and countless articles crediting her as the source *is* the protection. Filing for the trademark and/or copyright simply allows somebody to monetize something – and all efforts shall be made to ensure that the entity filing for the rights is the source and/or has the right to do so. Simply filing for it doesn't mean you have the right to do so.
