KANSAS CITY, Mo. — One Leavenworth man was convicted this week following a rolling shootout and a police pursuit that happened nearly two years ago.

The Leavenworth County Attorney says on Wednesday, Benjamin Allen McGee, 39, entered no-contest pleas to two counts of aggravated assault, one count of fleeing or attempting to elude a police officer and one count of interfering with law enforcement.

According to court documents, the interference with law enforcement charge stems from an incident where McGee is accused of fleeing a Leavenworth police officer on foot. Court documents also say that McGee committed aggravated assault on August 27, 2022 when he tried to burglarize an outbuilding in Leavenworth County.

When confronted by one of the victims, McGee pointed a gun at them and fired shots in their direction. Then, as McGee fled in a vehicle, a second victim pursued him and the two exchanged gunfire before a police pursuit stopped chasing him at the Missouri state line.

Lastly, court documents say that the fleeing or attempting to elude a police officer charge comes after a September 2022 incident where McGee fled from police in Leavenworth County.

Deputies had responded to the area looking for a stolen vehicle. While they were there, they witnessed a car driven by McGee leave a nearby driveway at a high speed. The deputies pursued McGee for almost 20 minutes before they lost sight of him.

Leavenworth County Attorney Todd Thompson said, “Thank you to law enforcement for working on these multiple cases to ensure the safety of our community.”

Sentencing is scheduled for Sept. 15, 2024.
