KANSAS CITY, Mo. — The owners of the home Larry Acree was illegally staying in are suing Acree for damages related to property and emotional distress.

On February 29, civil processors, Independence police and homeowner Craig Fedynich arrived at an Independence home to evict Acree.

Acree would not leave and shot and killed Civil Processor Drexel Mack and Independence Police Officer Cody Allen.

Fedynich witnessed the whole attack and is filing a civil suit for PTSD.

In addition to emotional distress, according to court documents, Fedynich claims he found bullet holes, destroyed flooring, broken doors and dead and decaying animals inside the property.

The lawsuit seeks an unspecified amount of money for damages.

Earlier this month a trial date was set for July 6, 2026 and could take around six weeks from jury selection to sentencing.

Court records show that Acree owed thousands of dollars to the county as property taxes went unpaid.

Acree faces two counts of first-degree murder, seven counts of first-degree assault, and nine counts of armed criminal action in what investigators say was an ambush on Allen, Mack and others who responded to his Independence home on Feb. 29.

The Jackson County Prosecutor’s Office notified the 16th Circuit Court back in May that it’s seeking the death penalty against Acree .
