    Man on probation arrested for possession of firearms including AR pistol and Glock “switch”

    GAINESVILLE, Fla. – Xavier Lamarious Kellogg, 19, was arrested on June 27 for violating probation, and the next day he was charged with two counts of possession of a firearm by an adjudicated delinquent under the age of 24.

    Kellogg has been on probation since May 2022, when he entered a plea of nolo contendere to attempted aggravated battery with a deadly weapon and possession of a firearm by an adjudicated delinquent and was sentenced as a youthful offender to two years of house arrest, followed by four years of probation, by Judge Phillip Pena, who withheld adjudication of guilt.

    Kellogg previously violated probation three times and served some time in jail earlier this year after the second violation; however, a month after his release, he violated the terms of his probation again by failing to attend mental health treatment sessions.

    On June 27, Probation and Parole officers reportedly went to his apartment to conduct a warrantless probation search after viewing a video of Kellogg handling two firearms, and Gainesville Police Department (GPD) officers accompanied them but remained outside the apartment.

    The Probation and Parole officers reportedly found a firearm, took a picture of it, and notified the GPD officers, who obtained a search warrant for the apartment. The Probation and Parole officers also turned Kellogg over to GPD officers, who took him into custody for violating probation.

    When the search warrant was executed, officers reportedly found an AR pistol, two loaded AR magazines, a 45 caliber bullet, a .40 caliber bullet, firearm accessories, and a Glock “switch” that makes a pistol fully automatic. All of the items were reportedly found in Kellogg’s bedroom, near his wallet, identification, and paperwork in his name.

    Kellogg was convicted of burglary of a vehicle when he was 14 and charged as an adult when he was 16 after he was arrested in connection with a February 2022 shooting at Pavilion on 62nd Apartments. In addition to the most recent charges, his probation officer reported that he gave the probation officer incorrect information about which room he was staying in and is $467.43 in arrears on monthly court costs payments.

    Kellogg is currently being held without bail for violating probation, and Judge Jonathan Ramsey set bail at $125,000 on the new charges.
