You can join in the conversation by calling in, sending chat messages, or accessing the Facebook group page "Real Talk with Rashad Richey." This discussion provided valuable insights into two complex legal concepts related to family law: grandparents' rights and caregiver equity.

Attorney Wilson explained that, under Georgia law, grandparents do have rights to seek visitation and custody under certain circumstances. However, the laws surrounding these rights are relatively new, and the first step to establishing legal standing is determining if a father has legal recognition as the child's parent. If not, grandparents may not have standing to seek custody or visitation. Even if the father is recognized legally, however, there must be a compelling reason for grandparents to pursue visitation or custody, such as a parent's death, incapacitation, or other extenuating circumstances.

In addition to grandparents' rights, Attorney Wilson also discussed caregiver equity, which is a newer development in Georgia law. This concept recognizes the contributions of third-party caregivers who have provided significant support to a child, such as a non-blood relative or legal parent. A caregiver can seek visitation or custody if they can demonstrate that they consistently care for the child's day-to-day needs and have established a bond with the child. The visitation or custody must also be in the child's best interest, with courts weighing factors such as the child's relationship with the caregiver, the nature of the caregiver's relationship with the child's parents, and the child's emotional and physical well-being.

Throughout the discussion, Attorney Wilson emphasized the importance of understanding legal standing and ensuring that any decisions made regarding visitation and custody are in the best interests of the child. She also underscored the importance of staying up-to-date with the latest developments in family law, especially since Georgia's laws surrounding these concepts are relatively new.
