Client’s tort claims against firm preempted by Bankruptcy Code
A Minnesota law firm filed an involuntary bankruptcy petition for nonpayment of $300,000 in legal fees. While its former client alleged state tort claims for filing the involuntary petition, the 8th U.S. Circuit Court of Appeals affirmed on Aug. 13 that he was unable to prevail for not successfully appealing the bankruptcy court’s final order.
