Battle Creek man sentenced for Camden pot shop burglary

HILLSDALE — The last of the four men arrested for the Jan. 31 burglary of The Pinnacle Emporium in the village of Camden appeared in the 1st Judicial Circuit Court Monday, Aug. 19 for sentencing.

Treyshaun Omeirr Boykins, 23, pleaded guilty to breaking and entering a building with intent to commit larceny on July 1 in a plea deal that resolved the case ahead of a scheduled September jury trial.

Charges of conspiracy to commit breaking and entering, receiving and concealing a stolen motor vehicle, third-degree fleeing police and resisting arrest were dismissed.

Boykins attorney, John Daly, argued Monday that since Boykins’ arrest Jan. 31 and his subsequent release on bond, he has taken strides to turn his life around and is gainfully employed and prepared to return to high school to complete his education.

“He knows what he did was without justification,” Daly explained as he requested a deferral under the Home Youthful Training Act.

Hillsdale County Prosecutor Neal Brady objected to a deferral similar to what Boykins’ three co-defendants got earlier on.

Authorities believe Boykins’ was the getaway driver of the group who led a Michigan State Police trooper responding to the burglary on a high-speed 130 miles-per-hour chase from Camden into Indiana and Ohio before turning northbound on I-69 and re-entering Michigan.

Troopers used stop sticks on I-69 south of Coldwater in an attempt to immobilize their vehicle which then exited I-69 onto eastbound U.S. 12 in Coldwater where a PIT maneuver was used to finally bring the high speed chase to an end.

All four men exited the vehicle after the PIT maneuver and attempted to flee on foot.

None of them have informed authorities who the getaway driver was.

Dontay Dequan Banks, 19; Milton Tyier Hudson, 18; and Jeramiah Javon Smith, 18 all pleaded guilty to breaking and entering a building with intent to commit larceny and were sentenced to nominal probation and fines under a HYTA deferral.

Judge Sara S. Lisznyai gave Boykins a chance to prove he is a man of his word with probation Monday.

“If you fail to do anything you’ve told me you will do, including obtaining your education, the next step will be for you to attend and complete the Twin Counties Probation Center,” Lisznyai said.

With advisory sentencing guidelines ranging from 0-9 months in jail for Boykins’ first criminal offense, Lisznyai imposed a two-year probation period with no further jail Monday.
