    The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated May 21, 2004, and duly recorded in the Office of the Clerk of the County Commission of Summers County, West Virginia, in Deed of Trust Book 207, at Page 576, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed of Trust Book 999, at Page 156, Christopher N. Judy and Mary J. Judy did convey unto Todd Taylor and Dan Kennedy, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Summers County Courthouse, in Hinton, West Virginia, on

    The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Green Sulphur District, Summers County, West Virginia, and situate in the New Haven District, Fayette County, West Virginia, and more particularly described as follows:

    All of the following piece or parcel of real estate located partly in New Haven District, Fayette County, and partly in Green Sulphur District of Summers County, West Virginia, being described as follows:

    BEGINNING at a steel rod and cap on the northerly right of way of W. Va. Route 20 near the Fayette-Summers County line, original corner to said 2 ½ acre tract; thence with said original line N. 50 6 02’ E. 214.57 feet to a steel road and cap being distant S. 50° 02’ W. 559.93 feet from a set stone, original corner to the 2 ½ acre tract; thence through said tract S. 48°05’ W. 111.21 feet to the center of W. Va. Secondary Route 44/1; thence with said center line S. 43° 13’ W. 51.34 feet and S. 26° 11’ W. 95.79 feet to a point on said northerly right of way of W. Va. Route 20; thence with said right of way N. 70° 35’ W. 100.00 feet to the point of BEGINNING.

    At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of Coon Creek Road, Meadow Bridge, WV 25976. We have reason to believe the property has a current mailing address of 1 Coon Creek Road, Meadow Bridge, WV 25976.

    AND BEING the same real estate which was conveyed to Christopher N. Judy and Mary J. Judy by Deed dated April 7, 1998, from Ira K. McGlothlin and Izetta Mae McGlothlin, and recorded in a) the Office of the Clerk of the County Commission of Summers County, West Virginia, in Deed Book 193 at Page 744; and b) the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 548, at Page 161.

    The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

    The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

    TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
