    Lawsuit filed in fatal Texas County accident

    A fatal Texas County accident that occurred in December 2023 has sparked a lawsuit in Texas County Circuit Court.

    An Indiana man, Richard Fish, filed a petition in connection with wreck that left him with injuries. Defendants are Poettker Construction Co. of Breese, Ill., and the estate of James Russo, who was a driver for the firm and lost his life in the accident.

    According to the lawsuit, Russo, 51, had amphetamine, methamphetamine, hydrodone and THC allegedly in his system at the time of the wreck, which closed down U.S. 63 near Gardner Ford south of Houston for several hours. Detours were put in place.

    The patrol said a 2016 Ford F-150 driven southbound by Russo traveled across the center of the road and struck a northbound 2021 Volkswagen Atlas operated by Latisha M. Harris, 43, of Fort Mitchell, Ala. The Russo vehicle continued southbound and hit a northbound 2013 Kenworth driven by Fish, 51, of Connersville, Ind., causing it to run off the right side of the highway, overturn and come to rest on its top. Russo, who was not wearing a seat belt, was ejected. He was declared dead at the scene.
