(WKBN) – The Supreme Court of Ohio has declined to hear an appeal of a Hubbard man serving 30 years to life in a rape case.

Kenne t h Nitso , 35, is serving his sentence in Belmont Correctional Institution. Nitso had been convicted of committing sexual acts against a girl under the age of 13 between May 2016 and May 2021, according to a news release from the Trumbull County Prosecutor’s Office.

The release stated that Ohio’s 11th District Court denied his appeal of the conviction and sentence in Judge Andrew D. Logan’s court.

Nitso’s appeal centered on the admittance of a polygraph test into evidence and argued that the jury’s instruction on the potential unreliability of the evidence was insufficient.
