    Buc-ee’s caught in the middle of legal fight between Huber Heights, Clark County

    HUBER HEIGHTS, Ohio (WDTN) — The Huber Heights Buc-ee’s is caught in the crossfire of a lawsuit between the city and Clark County.

    The Board of Clark County Commissioners has filed a lawsuit against the city of Huber Heighs over a dispute related to water and sewer services.

    In a court document filing with the Clark County Court of Common Pleas Court, the commissioners requested a restraining order intending to stop the City of Huber from using a different water and sewer system.

    In the filing, The Board of Clark County Commissioners listed its two issues:

    • That the City of Huber Heights sent a letter denoting plans for the city to pump sanitary flow from Centerpoint 70 (in Huber) to the Fairborn Water Treatment Plant, instead of the Clark County pump station.
    • That the City of Huber Heights plans to separate its water main at the west end of Centerpoint 70 Boulevard into two different systems.

    The letter, included in the court filing from Clark County, states that the city is currently constructing a new water pump station at S.R. 235, a relevant location to Buc-ees as well.

    In May, a detailed report outlined Buc-ees construction at S.R. 235 and I-70 . As a result, the proposed restraining order would halt progress made in bringing the mega-convenience store to the area.

    In response to the letter referenced in the filing, The Board of Clark County Commissioners claim that two agreements (made in 1988 and 1995) give the county exclusive jurisdiction in regards to water and sewer services from Centerpoint 70.

    A hearing has been set for July 25.

    The City of Huber Heights has not responded to the restraining order request as of this writing.
