Johnstown man allegedly stalked teen after raping her

CAMBRIA COUNTY, Pa. (WTAJ) — A Johnstown man is facing charges after he allegedly assaulted and raped a 15-year-old while they were working together at a fast-food restaurant.

Shawn Borsuk, 53, is accused of sexually assaulting an underaged girl he worked with at a restaurant, according to the criminal complaint. On March 28, officers from the Ferndale Borough Police Department were informed that a now 17-year-old girl had come forward to say that she had been assaulted by a former coworker and now he was allegedly stalking her.

The teen told officers that the assaults started when she was 15 after Borsuk allegedly kissed her one day while they were working. She added that after that Borsuk allegedly started to text her asking her how she felt about the kiss and that when they were working together, he would push himself up against her, according to the complaint. The juvenile also told police “It was like a relationship to him but not her.”

The juvenile told officers that after the kiss Borsuk performed sexual acts on her and raped her multiple times while they were working together. She added that most of these instances would occur when their boss had to leave to make deliveries. She also told officers that even after she left that place of work Borsuk continued to communicate with her.

Police noted in the charges that Borsuk was charged in June of 2023 after he allegedly performed sex acts on the victim, but they were dropped sometime later due to the victim not being emotionally prepared to testify. However, they were refiled in July 2024 along with several others.

On May 19, officers interviewed Borsuk after he violated a PFA, and he allegedly said that the relationship he had with the teenager “was more than just sexual.” Officers also spoke with Borsuk’s girlfriend who said she suspected that he was still contacting the juvenile as on three occasions she was able to track the phone that he used, which she paid for, to the juvenile’s current place of employment. The woman gave officers permission to seize the phone that he had been using and placed it into evidence, according to the complaint.

The teen also gave police a letter that Borsuk had left on her windshield outside of her address, which police noted that she said had never been given to Borsuk. The note read, “I’m not stalking you or trying to scare you. I was hoping you’d grow up enough to talk. (…) If anything had any meaning to you, please tell me the truth.”

In a re-interview about the assault in 2023, the juvenile told police that Borsuk would give her marijuana in exchange for sexual favors. She then said that even after she told him she didn’t want to be contacted again he continued to stalk her. Borsuk would allegedly come to her new place of employment, according to the juvenile and the supervisor at her new workplace.

The juvenile’s new boss also told officers that on one occasion Borsuk showed up with a Christmas gift for her, but her boss intercepted it and saw that he had attempted to give her a sex toy, according to the affidavit.

In text messages to the teen, Borsuk allegedly told her he was outside hiding in her parent’s shed and that he wanted to see her. Police also noted that in a second note, Borsuk tried to claim that the juvenile extorted him rather than him grooming her.

Police wrote in the affidavit, “The defendant took advantage of a misguided juvenile and lured her into a sexual relationship where he performed oral sex on her and made her perform oral sex on him as well as full on sexual intercourse with a minor juvenile below the age of consent.”

Borsuk is in Cambria County Prison with bail set at 10% of $750,000. He is facing felony charges of Rape, statutory sexual assault, involuntary deviate sexual intercourse, sexual assault, aggravated indecent assault without consent and corruption of minors. He’s also facing misdemeanor charges of indent assault without consent, indecent assault of a person less than 16, recklessly endangering another person and harassment.

He has a preliminary hearing scheduled for July 17.
