BAKERSFIELD, Calif. (KGET) — Charges have been dismissed against a Taft man accused of assaulting and threatening to kill his ex-girlfriend. Prosecutors said they were unable to obtain victim testimony.

Prosecutors on Monday dismissed charges of attempted murder, assault with a deadly weapon, spousal abuse and making criminal threats against Shawn Dakota Smith.

District Attorney’s Office spokeswoman Daniela Gonzaga said they’ll refile the case if the testimony becomes available.

“This was an essential component to the prosecution of this case, and therefore our office felt there was insufficient evidence to proceed at this time,” Gonzaga said in an email.

According to a court filing, Smith allegedly punched his ex in the face, cut her with a knife and threatened to kill her a day after they broke up in May. He was arrested the same day.
