SAN ANGELO, Texas ( Concho Valley Homepage ) — A San Angelo man has agreed to a plea deal following a stabbing incident that occurred at an apartment complex three years ago.

According to court records filed in Tom Green County, 50-year-old Steve Montemayor pled guilty to one charge of aggravated assault with a deadly weapon on Oct. 11. In exchange, he would be confined in the Texas Department of Criminal Justice for 12 years. The judge has not signed the plea as of the time of publication.

An affidavit filed in relation to the charge stated that law enforcement was dispatched to the Cross Keys Apartments complex, located at 1222 S. Abe St., at 12:48 a.m. on Oct. 19, 2021, in reference to a subject with a knife. Upon arriving at the scene, an officer witnessed a “male subject holding another male subject on the ground.” The man being held on the ground was identified as Montemayor.

The officer learned that Montemayor had stabbed an individual while the victim and others attempted to subdue him. The officer then detained Montemayor and placed him in handcuffs.

Other responding officers discovered that Montemayor “had been banging on doors at the Cross Key Apartments twenty minutes before the incident.” Officers arrived at the scene but left after being unable to find Montemayor, after which law enforcement received a second call in reference to Montemayor banging on doors and having a knife.

The victim advised that his girlfriend had “called about someone banging on her door.” The victim, his brother and his father then went to check on the girlfriend. The victim stated that the trio left but returned after his girlfriend called again and said Montemayor “returned and was banging on the door again.”

The victim said that his group got out of their vehicle and confronted Montemayor, who was wielding a cane. Montemayor reportedly began to swing the cane at the three individuals, causing them to back up toward Koenigheim Street.

The victim stated that Montemayor “displayed a knife.” He said that while he was attempting to flee, Montemayor stabbed him in the neck. The victim then stated that the group then tackled Montemayor to the ground and held him down until the San Angelo Police Department arrived.

Law enforcement spoke with the victim’s brother and father, who provided accounts similar to the one shared by the victim.

While speaking with the victim, an investigator noticed that the victim was observed to have a “penetrating non-life threatening cut to the right side” of his neck as well as “other superficial scratches around the neck and right cheek.” Patrol advised that the knife used in the encounter was recovered near where Montemayor had been tackled.

After being Mirandized by the investigator and agreeing to speak, Montemayor stated that the three individuals had “jumped him.” Despite this claim, it was noted that “no injuries were observed” on him.

Montemayor admitted to “drinking earlier and had taken his pills,” adding that he was “not acting in his right mind.” However, he “denied the knife seized was his and denied stabbing anyone.”

Montemayor consented to law enforcement entering his apartment. Inside the unit, the investigator observed “four empty tall cans of alcoholic beverages in the trash” and “smelled the odor of burnt marijuana.” The investigator later spoke with an officer, who stated that Montemayor confessed to having smoked marijuana prior to the incident.
