    Wrongful death lawsuit filed over Tipton inmate death

    JEFFERSON CITY, Mo. (KMIZ)

    A wrongful death lawsuit was filed on Thursday by the mother of an inmate who died last year at the Tipton Correctional Center.

    Brandon Pace died on April 7, 2023, according to Missouri Department of Corrections records. Tammy Reed filed the lawsuit against the Missouri Department of Corrections, former Director Anne Precythe , Acting Director Trevor Foley , three deputy directors , Warden Brock Van Loo, Matt Briesacher, Correctional Supervisor Terry Payne, 11 correctional officers and Centurion Health.

    The 11-count petition claims correctional officers believed Pace swallowed an illegal substance and chose to pepper spray him instead of giving Pace medical attention. Pace allegedly called for help for several hours, but was not given medical treatment before he died, the petition alleges.

    The petition alleges a cover-up was done by MoDOC and claims false reports and statements were made about Pace receiving medical treatment. The lawsuit also claims that MoDOC did not respond to records requests.

    Counts in the lawsuit against the defendants include: Breach of contract as a third-party beneficiary, use of excessive force, deliberate indifference, Civil Rights conspiracy, unconstitutional practices, failing to train or supervise staff, assault, wrongful death and a Sunshine Law violation.
