    Washington, Clackamas counties sue Oregon Health Authority over Measure 110 funds

    PORTLAND, Ore. ( KOIN ) – Washington and Clackamas counties filed a lawsuit against the Oregon Health Authority on Tuesday, challenging the way Measure 110 funds are distributed to counties.

    Measure 110 was previously approved by voters in 2020 to decriminalize drugs in favor of treatment options. The measure created a funding program for Behavioral Health Resource Networks to provide services such as screenings, health assessments, and pathways to recovery for people with substance use disorders.

    Since Measure 110 was rolled back earlier in 2024 under House Bill 4002 , OHA and the Oregon Accountability Council created a formula to determine how much revenue is distributed for county deflection programs, with funds reaching over $400 million, the counties explained.

    The counties claim OHA and OAC created a spreadsheet formula for proportioning funds to Behavioral Resource Networks in each county based on undisclosed equations and did not provide a public notice, hearing or comment period for the funding formulas, which put Washington and Clackamas counties at a funding disadvantage, the lawsuit argues.

    OHA told KOIN 6 News the agency does not have a comment at this time.
