    Former NMSU basketball player wants witness testimony excluded in case

    LAS CRUCES, N.M. (KRQE) – One of the three former New Mexico State University men’s basketball players charged with raping some of his teammates is trying to get witness testimony thrown out. Lawyers for Kim Aiken Jr. filed a motion in June asking to exclude testimony from witnesses they said the state included in their case too late.

    In the motion, lawyers claim the state had until mid-January of this year to determine what witnesses they would call but submitted an updated list on May 30. Those witnesses include six other former players, three student managers, and four coaches including former Head Coach Greg Heiar.

    The state argued they only had to submit a list of witnesses they intended to call and only updated their list at a later time. They also said the defense has been well aware of the additional witnesses throughout the case.

    Aiken Jr., Doctor Bradley, and Deshawndre Washington each face more than 20 years in prison if convicted. Their trial is scheduled for October 21.

    Former head coach Greg Heair is not facing any charges and was hired as a head coach for a junior college in Missouri last year. He is now at Trinity Valley Community College in Athens, Texas.
