ALBUQUERQUE, N.M. (KRQE) – The trial against former Bernalillo County Sheriff’s Deputy Michael Borrecco continued on Tuesday. Borrecco is accused of being drunk and pulling a gun on two men at a Circle K on Osuna while off-duty in January 2024.

Michael Ruiz called 911 after he said Borrecco pulled a gun on him and his friend Deaven Carey. The defense said that Ruiz made the story up. Borrecco’s lawyers said Ruiz was arrested by BCSO days before the incident back in June. They said Ruiz fabricated the story because he was upset with the department.

They claimed the 911 phone records taken by the operator which show that he knew Borrecco was in law enforcement. The state said it didn’t prove anything. Ruiz told the court that he was never convicted for his arrest and the charges have been dismissed.

The state also showed new video in court, which KRQE News 13 didn’t have access to, that showed Borrecco making a purchase at the gas station. Ruiz later said during testimony that he saw the then-off-duty deputy buy a bottle of vodka. Albuquerque police found more than 15 empty vodka bottles in Borrecco’s truck.

The state played new video showing Ruiz and Carey walking over to Borrecco’s vehicle, where they say he pulled a gun on them. Borrecco is on trial for assault and gun charges. If convicted, Borrecco faces up to a year and a half behind bars. The trial is scheduled to end on Wednesday.
