Car dealership, owner must pay $110K for violating judgement

WICHITA, Kan. (KSNW) — A Sedgewick County Judge has ruled that a Wichita used car dealership and its owner must pay for violating a consent judgment they agreed to last year .

The Sedgwick County District Attorney’s Consumer Protection Division filed motions against 37 Auto Sales, LLC, and its owner, Jacobs Lucky, arguing that they have still not made the required payments they agreed to in last year’s consent judgment. The judge has ordered the full amount of each judgment to be due immediately and imposed an additional $20,000 penalty on each.

That means the dealership now owes $80,000, while the owner owes $30,000. The dealership and Lucky are prohibited from selling cars in Kansas until the judgment is paid, and Lucky has also had his license to sell cars in the state revoked.

The dealership was accused of selling cars without providing titles, not honoring warranties, failing to notify about recalls, and issuing multiple 60-day temporary tags on nine vehicles, which violates Kansas law. State law mandates that the consumer receive titles within 60 days, or the sale is fraudulent and void, and the consumer is entitled to a full refund.

It’s not the first time 37 Auto Sales has been in trouble with the DA’s office. According to court records, they entered into a consent judgment totaling $23,581.51 in 2019.
