    Mandan man sentenced to five years in prison for assaulting girlfriend

    MANDAN, ND ( KXNET ) — Joshua Nerby pled guilty on Monday, August 12, in Morton County District Court to assaulting his girlfriend and keeping her from leaving a Mandan home in July.

    Mandan police say the woman tried to call police, but Nerby grabbed the phone out of her hand as she was calling 911. When asked about it, Nerby told police he and the woman were arguing because she woke him up and accused him of cheating.

    Nerby was sentenced to five years in prison for pleading guilty to aggravated assault, felonious restraint, and interfering with a 911 phone call. As part of the plea agreement, he will also serve three years of supervised probation, and not have any contact with the victim.
