BISMARCK, ND ( KXNET ) — A sentencing hearing has been rescheduled for Daedyn Lewellyn — a 19-year-old Bismarck resident who was found guilty of terrorizing two people last summer at their home.

Lewellyn appeared in Burleigh County District Court with his attorney on Monday, September 16 for a sentencing after being convicted of terrorizing with a dangerous weapon, reckless endangerment, and failure to inform an officer that he had a concealed weapon.

During the hearing, Judge James Hill postponed Lewellyn’s sentencing, after his lawyer told the judge they had just received his pre-sentencing investigation report — and thus, had no time to review it and prepare for the hearing. State law requires that a person convicted of a crime has fourteen days to review their PSI before they can be sentenced.

According to an affidavit, Lewellyn was arrested last summer, after police responded to a call that he got into an argument with two people at their home and pulled a gun on one of them.
Police said they later caught up with Lewellyn near the U-Haul on Interstate Loop, and then was shot by a Bismarck Police Officer. He was later treated at a hospital for his injuries.

Judge Hill also granted Lewellyn’s request to dismiss his fifth attorney and instead represent himself in his upcoming sentencing, which has yet to be scheduled.
