    ‘No murder charge’ in Buda shooting death

    HAYS COUNTY, Texas (KXAN) — A 21-year-old man will not be charged with murder in connection with the shooting death of a 17-year-old in Buda on Aug. 5, according to Hays County Criminal District Attorney Kelly Higgins.

    A release said the shooting occurred in a drainage area behind homes in the 800 block of Shadow Creek Boulevard at approximately 5:15 p.m.

    Hays County deputies responded and found 17-year-old Erick Alejandro Marin who had been shot. He died at the scene, according to law enforcement.

    Investigators acquired two videos of the shooting, which were filmed by people present.

    Officials said the video showed two groups meeting at the location to fight.

    “A juvenile relative of Marin’s was fighting a 21-year-old male. During the fight, Erick Marin pulled a handgun and started shooting at the 21-year-old. A juvenile male from the opposing group returned fire before the 21-year-old grabbed that weapon and shot Marin, killing him,” the county said.

    Officials said Marin was the first person to draw and fire a weapon.

    “The District Attorney’s Office reviewed all of the evidence and concluded that the shooting that killed Marin was justified under the Texas laws related to self-defense and defense of a third person,” the county said.

    Officials said the other juveniles present and involved could still face charges.
