Lafayette man charged with rape

A Lafayette man was charged with rape and sexual battery Wednesday afternoon after allegedly attempting to forcibly pull down the victim’s pants and perform oral sex.

Officers with the Lafayette Police Department responded to a report of an alleged sexual assault at a business on Union Street April 17, according to the probable cause affidavit.

The victim, identified in the affidavit as Victim 1, reportedly said they were sitting in the passenger side of the vehicle when 38-year-old Levi Foster approached them.

The window was down and Foster was speaking to the victim when he suddenly opened the door and allegedly “grabbed (the victim’s) pants, attempting to pull them down,” the affidavit said.

Victim 1 said they tried pushing Foster’s arms away while telling him to stop while he was allegedly pulling on her pants and eventually Foster let go and walked away from Victim 1’s vehicle.

According to the report, Victim 1 was “visibly shaken up” by the incident and said she felt “trapped” and thought Foster was going to rape her. Victim 1 and a witness to the incident both picked out Foster in a photo array, the affidavit said.

Officers interviewed Foster the following day and he reportedly said during his conversation with Victim 1, he decided to perform oral sex on her and opened the door and tried pulling her pants down. According to reports, Foster said he would have engaged in sexual activity with Victim 1.

Foster was charged Wednesday with rape, a level three felony, sexual battery, a level six felony and a misdemeanor charge of battery.

As of Wednesday evening, Foster is not listed as an inmate in the Tippecanoe County Jail registry.
