According to the Department of Justice (DOJ), Cutter admitted that on June 27, 2023, he exchanged sexually explicit texts with someone he believed was an adult offering services of a 12-year-old girl, in an attempt to entice the child to engage in sexual acts with him. He also admitted he traveled to a pre-determined location in Warren County to engage in sexual acts with the 12-year-old.

Cutter was arrested shortly after arriving at the location. He will be sentenced on November 11. He also faces a term of post-release supervision of at least five years to life and the court may impose a fine of $250,000 in restitution.
