    Lake Oswego luxury condominium case resolved

    The case between the developer of a new luxury condominium development and a nearby homeowner’s association has been settled after it was briefly reopened.

    In May, Clackamas County Circuit Court issued a general judgment of dismissal because the case was settled or resolved.

    The Oswego Talisman Condominium Association had filed a lawsuit against the owners of the future Frances condominiums, Hugh Development (and its affiliated LLC North D State) in 2022 over a sewer line that the association alleged was ruptured during construction of the luxury condos next door. The case was eventually dismissed due to a settlement agreement the two parties signed.

    The court reopened the case earlier this year at the request of the condo association, which stated that it had yet to be paid $35,000. According to court submissions, Hugh Development agreed to pay $790,000 (most of which went to a contractor for repairs) through the initial settlement.

    The court dismissed the case again on May 6.
