    Man gets second DUI after crashing ATV

    BOONE COUNTY, WV (LOOTPRESS) – A man gets his second DUI after crashing ATV , and deputies find up to 10 beer cans scattered across the road.

    On Monday, August 12, 2024, at around 9:28 PM, Deputy Hicks was sent to 30827 Pond Fork Road in Bim regarding a possible motor vehicle accident. Upon arrival, he found the driver, Dewey Ellis, referred to as the defendant, standing near an overturned ATV. The vehicle was on its side, with eight to ten beer cans scattered across the road. It had veered off the road and collided head-on with a row of bushes, causing it to flip.

    The defendant tried to walk over to the deputy’s cruiser but stumbled and fell, regaining his balance by holding onto his car. He claimed he was driving and lost control, expressing confusion about what had happened afterward. The defendant had difficulty forming sentences, and the smell of alcohol on his breath was strong. He admitted to having “drinking a few beers” and repeatedly said, “I messed up real bad” while speaking with the deputy and the EMS personnel.

    Deputy Hicks received information from the Boone E-911 Center indicating that the defendant’s license was suspended due to a DUI. Hicks informed him that he suspected he might be impaired and asked if he would agree to some field sobriety tests. He responded, “Go ahead and take me to jail; I’m not doing any tests.”

    After that, he began to complain of pain and requested to be taken to a hospital. He was then transported to Boone Memorial Hospital, where he declined most medical treatment and refused to submit to a blood draw or answer any questions. While at the hospital, he admitted to a nurse several times that he had consumed a significant amount of alcohol.

    Ellis was charged with a second DUI, driving revoked DUI, and refusable to fingerprint.
