The parents of a 17-month-old who drowned in a bathtub in August have been indicted by a Cobb County Grand Jury.

Kenton Hamilton told police he fell asleep with his son, Devoneir Allen Hamilton, sleeping on his chest on the first level of his west Cobb residence on Aug. 1.

At some point, Kenton Hamilton's arrest warrant states, his son woke up and "walked up two flights of stairs, climbed into the bathtub, and turned the water to the tub on and drowned."

Kenton Hamilton was arrested on several charges, including murder, in August.

Now, the Cobb County Grand Jury indicted him on charges of murder, cruelty to children, possession of cocaine, tampering with evidence and four counts of possession of a firearm by a convicted felon.

According to the indictment, while Kenton Hamilton was on the phone with 911 requesting help for his unresponsive son, he was instructing another person to remove evidence from the home.

Shortly after officers arrived on scene to investigate his son's death, Kenton Hamilton allegedly discarded a bag filled with controlled substances.

Prosecutors say Charlotte Grasse, who is identified as Devoneir Hamilton's mother in the toddler's obituary, went to the Kennesaw home four days after her son's death to remove that bag from the home. She has been indicted on one count of tampering with evidence.

"He was so perfect and pure. His mother and father and closest aunts and uncles were his life," the toddler's obituary reads.

Kenton Hamilton is being held in the Cobb Jail without bond. Grasse does not appear in Cobb Jail records.
