    Lawrence O’Donnell Slams ‘Republican Supreme Court’ As A ‘Stain’ On American Democracy

    MSNBC host Lawrence O’Donnell slammed the “Republican Supreme Court” as a “stain” on American democracy, arguing that the court’s recent immunity decision was one of “Republican convenience” and “not a product of legal scholarship.”

    O’Donnell was reacting to the superseding indictment filed Tuesday by Special Counsel Jack Smith regarding alleged efforts by former President Donald Trump to interfere in the 2020 election. The new filing replaces a previous existing indictment to bring the same four charges as before, but now tailored to reflect the Supreme Court’s ruling in Trump v. United States on the issue of presidential immunity.

    Blasting the immunity decision, the host said:

    The Supreme Court ruled any crime Donald Trump conspires to commit in the Oval Office with appointed members of the executive branch, any of those crimes are crimes the Supreme Court believes the founders wanted the president to get away with. The Republican Supreme Court is, of course, insanely wrong about that.

    That decision was not a product of legal scholarship, that decision was a product of Republican convenience. Every justice who voted in support of that opinion is a Republican.

    Continuing, O’Donnell criticized the partisan composition of the court justices, with conservative justices holding a 6-3 supermajority, and lambasted the Electoral College process for delivering it.

    Only one [conservative justice] was appointed by a president who entered the presidency by winning the most votes. George H.W. Bush is the last Republican president who entered the presidency by winning the most votes. That was in 1988. He gave us Clarence Thomas. If you lived in a democracy, where the candidate with the most votes wins, there would be no other Republican justice currently serving on the Supreme Court. Clarence Thomas would be the only one.

    The current composition of the Supreme Court stands, in my view and in my view alone, as a stain on America’s claim to the world that it is a democracy. And no other democracy in the 21st century would seven out of 50 states decide presidential elections through an electoral contrivance created in a slaveholding country 235 years ago, a contrivance they tried to make sound serious by calling it a college – the Electoral College. The Electoral College gave us this Supreme Court, not the voters. That Supreme Court has given Donald Trump his immunity.
