    Counsel used documentary-style family video to help settle case

    This case involved a tragic motor vehicle collision in Huron County that resulted in the death of David Caister, a beloved and special 58-year-old man from Cass City.

    The collision occurred at approximately 7:32 p.m. on Aug. 19, 2022, at the intersection of Caseville Road and Stein Road in Winsor Township.

    David Caister was driving his 2002 Jeep Liberty, traveling southbound on Caseville Road and approaching the intersection with Stein Road. At that intersection, there are stop signs for eastbound and westbound traffic on Stein Road. There are no stop signs for northbound and southbound traffic on Caseville Road.

    Avery Kuhl was driving a 2010 Dodge Ram 1500 westbound on Stein Road and was approaching the intersection with Caseville Road. The 2010 Dodge Ram 1500 that Avery Kuhl was driving was owned by Ryan Kuhl.

    As Avery Kuhl approached the intersection, he was not paying attention to the roadway and disregarded the stop sign. As a result, Avery Kuhl drove into the vehicle driven by Caister, resulting in a violent collision. Caister sustained catastrophic injuries and was pronounced dead at the scene.

    Caister was survived by his wife, Rebecca Caister, as well as three daughters, multiple grandchildren, his mother and multiple siblings.

    After securing Rebecca Caister’s appointment as personal representative of the estate, plaintiff’s counsel developed a comprehensive plan for presenting the enormous damages in the case. That plan included retaining a professional filmmaker to create a documentary-style about the Caister family. The film-making process involved lengthy interviews with family, friends and community members, as well as culling through hundreds of family photos and videos.

    After finalizing the damages presentation, plaintiff’s counsel submitted it to the insurer for Kuhl, along with a request that the insurer tender and verify the full limits of applicable liability coverage. The insurer produced one auto insurance policy covering the vehicle driven by Avery Kuhl and another umbrella policy, along with affidavits confirming that there was no other insurance coverage.

    With this information, the proposed settlement was submitted for approval to the Tuscola County Probate Court, which approved the settlement, payment of attorney fees, and distribution to the interested persons.
