    State Rep. Evan Goyke to remain in Assembly while serving as Milwaukee city attorney

    State Rep. Evan Goyke (D-Milwaukee) has said that he will not resign from his position in the Assembly after winning election to serve as Milwaukee city attorney last week.

    Goyke said on the WISN-TV Channel 12 Sunday news program Upfront that he will hold both positions because of the close margins in the Assembly, and the potential for Republicans to hold a legislative supermajority and override a veto from Democratic Gov. Tony Evers if he were to resign.

    “There is too much at stake. I am unwilling to hand the keys to our democracy over to the Speaker,” Goyke said, referring to Rep. Robin Vos (R-Rochester). “I’ll be able legally to do both jobs and ready and willing to serve the people of the 18th [Assembly district] should there be issues that come up in Madison.”

    Republicans in the Assembly have held a 64-35 majority this legislative session, just two seats shy of a supermajority. Those margins will become closer after Rep. Marisabel Cabrera’s election to the Milwaukee County Circuit Court. She will be required under state law to resign her seat in the Assembly.

    Lawmakers wrapped up their work in the Capitol last month and aren’t expected to return for additional legislative work until next year.

    Republicans already hold a supermajority in the Senate, and with a supermajority in the Assembly, Republicans alone could override any of Evers’ vetoes. Goyke said that Vos would be “quite likely to take advantage of having a supermajority.”

    While Goyke plans to stay in the seat through the end of the term, he won’t run for reelection in the Assembly this year.
